Confident Pass Driving School

The terms and conditions contract is made between the instructor authorized by Confident Pass Driving School, School of Motoring and the client in person. 

  Interpretation:

  • The words imparted are either or plural, and even vice versa, and all the words involving the genders include all genders. 
  • The instructors are franchised with Confident Pass Driving School, and they are referred to as the instructors.
  • According to all the terms, Confident Pass Driving School will be referred to be the school. 

Provision of training and training material:

  • Your instructor will provide the training at the mentioned rate within your preferred area. 
  •  Confident Pass Driving School will provide instructors who are qualified, approved and licensed by (DVSA), the Driver and Vehicle Standards Agency.
  • The instructor will adhere to the professional code of conduct and will strive to be tidy and punctual. 
  • The date, time and pick-up or drop-off point for each session will be agreed in advance by both parties. 
  • The drop-off point might be different to the pick-up point, it all depends on the time taken. If it takes 30 mins, then the charges will be £20. If the drop-off distance is close between 30 to 45 minutes or even one hour, then the charges will be higher. If it takes you 40 mins to pick up and 40 mins to drop, then the candidate will be charged just like hiring a taxi, and need to pay for the travelling time.  
  • The training will be carried out in the school or instructor’s vehicle.

  Prices and payments:

  • The prices mentioned are not to be changed at any time, thus the candidate needs to follow the website. Any money that has already been paid will be non-refundable. 
  • A complete payment must be made the day before the test. 
  • Payments are only accepted by bank transfer, and it is important to ensure that the payment is non-refundable. 

Client’s obligations:

  • The candidate must be able to read a number plate at a distance of 20.5m or 67 feet. (This is also essential with eyewear if normally worn) 
  • The candidate must ensure to be in a healthy state to drive safely and should not be under the influence of alcohol or any substance that might affect his/her ability to drive. 
  • Also, any medical condition, both physical and mental issue, can affect the training. This must be indicated before the lesson or as soon as possible. 
  • The candidate must behave appropriately, along with other road users and the instructor. Any offensive attitude will not be encouraged. 
  • If the instructor considers the candidate to be in an unsuitable state to drive safely, or they behave offensively, the session might get suspended and no refund will be provided. 

The School vehicle:

  • All the vehicles of the school are fitted with dual controls ensuring that the vehicle will be maintained in a clean and tidy condition. 
  • The school or the instructor will not take up any liabilities for any failure of the vehicle, during the lesson or the practical driving test. 
  • Also, it is essential to make sure it is not the result of negligence on the part of the school or the instructor. 

Practical driving test:

  • The expert instructor will inform the candidate when he/she is ready to take the practical driving test. This does not ensure that the candidate will pass the test, and the school will not be liable if the individual fails the test. 
  • If the tuition vehicle becomes unavailable for the driving test, the test will be postponed. It might be close to or during your test time, but you can appear for your driving test free of cost. The candidate will receive 2 hours of free driving lessons for the next test. 
  • The school will not be liable if the test is cancelled by the test centre, because of other random circumstances, other than the one’s within the instructor’s responsibility. The instructor will not be responsible for the required documentation, that must be provided by the student, along with having the required level of eyesight or the fitness to drive. 

Limitation of Liability:

  • These terms and conditions will limit the instructor’s liability in any claim for death or personal injury that might be caused by the instructor’s negligence. 
  • The instructor is not liable for any damage to loss of property, that the candidate brings with him/her or might leave it behind in the vehicle. 
  • Neither the school nor the instructor will take the liability for the consequences of any event, that happens outside the school or beyond the school’s or instructor’s control or expectation. 

   General:

  • The school and the instructor will comply with the Data Protection Act 1998 at all times. This ensures that the candidate’s details to any third party should not pass without that individual’s consent. The consent to their details is to be passed onto the school’s or the instructor’s insurance vendors, during an actual or potential claim. This information of individual details is to be arranged for motor vehicle insurance coverage. 
  • Each right or remedy of the driving school under these Terms and Conditions is without any prejudice to any other right or remedy of the school. 
  • These Terms and Conditions will be governed and implied in accordance with the laws of England, and they submit to the exclusive jurisdiction of the English Courts. 

Complaints Procedure:

  • Any candidate complaints should be directly directed to the instructor.
  • This contract is between the client and the instructor that is being franchised by the driving school. The school here can act as a mediator, the emails will be responded to within 7 days and the letters within 14 days. When necessary the complaints will be fully investigated and the resolution proposals will be given within 28 days.
